====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 4.9.2017, seeks bail in Majhaulia PS Case No. 157 of 2017 registered under Sections 394/34 of the IPC.

The allegation in brief is that the informant was robbed by four motorcycle borne miscreants and relieved of money and other items.

Learned Counsel for the petitioner submits that there is no material against the petitioner, except disclosure of his name in the confessional statement of one Gyan Kumar @ Gyan Sah, neither any incriminating material has been recovered from his possession nor he was put on TIP, besides this he is in custody since 4.9.2017. Having considered the said facts and circumstances, the petitioner, namely, Asraf Sai @ Ambuz is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM West Champaran at Bettiah in connection with Manjhaulia PS Case No. 157 of 2017 with the following conditions:- (i) one of the bailors shall be a close family member of the
