Petitioner, already in custody, seeks bail in connection with Sabour P.S. Case No.132 of 2006, giving rise to S.T. No.385 of 2013, registered under Sections 448, 376, 511, 323, 504 and 34 of the Indian Penal Code.

Allegation in brief is that in the midnight, one person entered into the house of the prosecutrix and started removing her clothes, when she woke up then he fled away but identified by her in the flash of torch light.

Submission is that merely on the basis of suspicion, the petitioner is made accused and the petitioner is in custody since 19.09.2017.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.9525 of 2018(2) dt.19-02-2018 2/2 petitioner Kanhai Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, Bhagalpur in connection with Sabour P.S.
