JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2015 This modification application has been filed for modifying the order dated 16.1.2015 passed in Cr. Misc. No. 29884 of 2014.

It has been submitted that the submission of behalf of the petitioner was that she is ready to deposit half of the alleged amount and rest amount in installment subject to the out-come of the litigation but the same has not been mentioned in the order dated 16.1.2015, and as such, the same may be modified to that extent.

Learned counsel representing South Bihar Power Distribution Company Ltd. got no objection.

Accordingly, the order dated 16.01.2015 passed in Cr. Misc. No. 29884 of 2014 is modified to the extent that the

Patna High Court Cr.Misc. No.8514 of 2015 (2) dt.18-03-2015 deposit of alleged amount by the petitioner is the subject of outcome of the litigation and further the time of deposit of half of the amount and her surrender before the court below is hereby extended for further one month in connection with Munger (Muffasil) P.S. Case No. 251 of 2013 from the date of receipt/production of a copy of this order.

In the result, this modification application is allowed to the extent indicated above.

Let this order be communicated to the court of learned Chief Judicial Magistrate, Munger in connection with Munger (Muffasil) P.S. Case No. 251 of 2013 through fax at the cost deposited by the petitioner.
