The petitioner seeks bail in Chakai P.S. Case No. 157 of 2017 registered for the offence punishable under Sections 395 and 379 of the Indian Penal Code.
Informant in his written complaint has stated that on 14.11.2017 they slept after taking meals and at about 12:15 pm in the night six to seven miscreants entered into the house by climbing the wall and looted gold ornaments as well as cash of Rs. 50,000/-. The FIR is against unknown. However, informant and other family members claim that they can identify the accused.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.15200 of 2018(3) dt.12-04-2018 2/2 the name of petitioner had surfaced in this case on the basis of suspicion only and there is no incriminating material against him except his own confession. No TIP has been conducted and petitioner is in custody since 16.11.2017. There is one case registered against the petitioner under Section 414 of the IPC in which bail has been granted to him.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd Jamui in connection with Chakai P.S. Case No. 157 of 2017.
