Petitioner, already in custody, seeks bail in connection with Gopalganj (Town) PS Case No.333 of 2017 registered under Section 394 of the Indian Penal Code. Later on Sections 302/34 of the Indian Penal Code were added.

Allegation in brief is that while the informant was coming along with his uncle on a motorcycle, on the way accused persons robbed him and also shot at his uncle causing his death.

Learned counsel for the petitioner seeks bail of the petitioner on the ground of parity as one of the co-accused Safir Ahmad has been admitted to bail by a co-ordinate Bench of this

Patna High Court Cr.Misc. No.12475 of 2018(3) dt.18-04-2018 2/2 Court vide Cr. Misc. No.13237 of 2018 on 08.03.2018. It is further submitted that the only material transpires against the petitioner is disclosure of his name by co-accused Shibu @ Sarfaraj and the petitioner is in custody since 30.08.2017. Having considered the aforesaid facts and circumstances, petitioner Shahid Parvej @ Mohan @ Rehan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Gopalganj (Town) PS Case No.333 of 2017 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to the cancelled. (Arun Kumar, J) S.KUMAR/- U T
