2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 140(3) of the B.N.S. and later on, Sections 103(1), 238, 61(2) and 3(5) of the B.N.S. were added.
3. As per F.I.R., on 03.06.2025 at about 05:00 PM, informant's son, namely Manish Kumar, had gone out of his house but he did not return. The informant tried to contact on mobile phone but it was switched off. Later, dead-body of informant's son was found.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has
Patna High Court CR. MISC. No.12945 of 2026(2) dt.23-04-2026 2/2 committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired in this case during investigation, merely on the basis of confessional statement of co-accused persons. Save and except confessional statement, there is no other material on record to show the complicity of this petitioner in the alleged offence. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that name of petitioner transpired in this case during investigation on the basis of confessional statement of co-accused Ankit Kumar and Rajesh Kumar who have stated that they, along with this petitioner, committed murder of the deceased.
6. Considering the facts and circumstances of the case, gravity of offence and materials that have surfaced during investigation, the prayer for grant of anticipatory bail to the petitioner is rejected.
