JUSTICE SUDHIR SINGH ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 25(1-B)A, 26 and 35 of the Arms Act. Allegation is that one country made pistol loaded with five cartridges was recovered from the possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.1.2017 and charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. One loaded country made pistol is said to have been recovered. There is no compliance of
Patna High Court Cr.Misc. No.22946 of 2017 (2) dt.22-05-2017 2/2 Section 100 of the Cr.P.C. It is further submitted that the petitioner may be released after completion of six months in custody from 6.1.2017.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody from 6.1.2017 on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil (Lakho) P.S. case No.06 of 2017.
