JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner apprehends arrest in connection with Nagar/Sahayak P.S. Case No. 21 of 2017 registered under Sections- 20, 22 of the NDPS Act.
Learned counsel for the petitioner submits that petitioner is auto driver and he had no knowledge of the articles kept inside the auto. Nothing has been recovered from the conscious possession of the petitioner. He has been implicated in this case on suspicion.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is recovery of 40 Kg Ganja from this petitioner which is commercial quantity.
Patna High Court Cr.Misc. No.19720 of 2017 (4) dt.23-06-2017 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
