This is a case registered under Sections 18, 22, 27 and 27(b) of the N.D.P.S. Act in connection with Narkatiyaganj Rail P.S. Case No. 2/2017.
It has been submitted on behalf of the learned counsel for the petitioner that he along with two other accused persons have been apprehended from the train. The allegation in the F.I.R. is that from possession of other apprehended person, namely, Avinash Kumar Giri, small sachet of Smack has been recovered. On perusal of the F.I.R., it is obvious that nothing has been recovered from the possession of the petitioner. His name surfaced
Patna High Court Cr.Misc. No.30007 of 2017 (2) dt.06-07-2017 2/2 in this case in his confessional statement and though he has a criminal antecedent which has been mentioned in paragraph 3 of the petition. He has been remanded in this case. He is in custody since 19.01.2017.
Considering the above submissions, prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional District & Sessions Judge Bettiah (West champaran) in connection with Narkatiyaganj Rail P.S. Case No. 2/2017.
