JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Patliputra P.S. Case No. 236 of 2014 registered for the offences punishable under Sections 328, 302 of the Indian Penal Code. Petitioner happens to be own sister in law of the deceased and it appears that there was dispute in the family of the deceased on the point of partition. It is not in dispute that the deceased died of poison and it is only stated that petitioner as well as her husband administered poison to the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact
Patna High Court Cr.Misc. No.12137 of 2015 (3) dt.01-05-2015 that petitioner is a lady, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Patliputra P.S.
