JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Beldour P.S.Case No. 31 of 2017 registered under Sections 406 and 420 of the Indian penal Code.

Allegation in brief is that informant and other traders used to give money to the petitioner, a driver of the commercial vehicle, to purchase articles of the shop from Khagaria and all four traders together gave him Rs. 1,60,000/- but he neither brought articles nor returned back money.

Submission is that petitioner is the driver of a commercial vehicle and due to dispute with owner, he has been falsely implicated, moreover, there is no reason for giving money by the informant to the petitioner for purchasing any article and is in custody since 16.11.2017.

No.18495 of 2018 (2) dt.03-04-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Suman Sharma, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. C.J.M.-III, Khagaria in connection with Beldaur P.S. Case No. 31 of 2017.
