The petitioner seeks bail in Kanti P.S. Case No.37 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant got information that some liquor traders had assembled near Sanichra Temple and on such information, the informant and other police officials went there and raided a litchi orchard. The informant recovered 301 litres of foreign liquor of different brands. It is further alleged that the petitioner was apprehended and he disclosed his name as Shubham Kumar.

Learned counsel for the petitioner submits that the petitioner was going towards village but on mere suspicion

Patna High Court CR. MISC. No.11009 of 2020(2) dt.03-03-2020 2/2 petitioner was arrested and implicated in the case. There is nothing on record to show that the petitioner had kept the liquor in the litchi orchard. The petitioner is in jail since 19.01.2020 and he has got no criminal antecedent.

Considering the facts and nature of allegations made against the petitioner, petitioner, namely, Shubham Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Kanti P.S.
