2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 3(5) of the B.N.S., 2023. 3 . As per prosecution case, informant namely, Shriram dubey alleged that on 30.06.2025, due to land dispute, all the accused persons named in the F.I.R. including this petitioner assaulted informant and other family members, as a result of which, brother of informant died.
4. Learned counsel for the petitioner submits that specific accusation of assault to the deceased is against other coaccused persons. Petitioner is not assailant of the deceased. As per F.I.R. 7 persons are alleged to have assaulted deceased and

No.12266 of 2026(3) dt.13-05-2026 2/2 nephew of the informant but as per postmortem, doctor has found only one injury on the body of deceased which itself falsifies the entire prosecution case . Petitioner is in custody since 05.01.2026 . Chargesheet has already been submitted. 5 . Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for bail.

Considering the aforesaid facts, period of custody and other circumstances of the case, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Siwan in connection with Raghunathpur P.S.
