JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-07-2016 In compliance of this court's order dated 04.07.2016, a supplementary counter affidavit has been filed on behalf of the District Provident Fund Officer, Nalanda. The District Provident Fund Officer, Nalanda, is personally present also. Along with supplementary counter affidavit, a chart showing calculation of deposits made in the General Provident Fund account of the petitioner and the interest thereon has been brought on record. As per the said chart, it appears that the petitioner has been found entitled to a total sum of Rs. 3,78,088/- against General Provident Fund amount. Out of the said amount, a sum of Rs. 3, 63,502/- had already been
Patna High Court CWJC No.5111 of 2012 (5) dt.18-07-2016 2/2 sanctioned earlier and paid to the petitioner. Upon verification, the payment of the rest amount i.e. 15,793/- has also been sanctioned and paid to the petitioner.
Learned counsel for the petitioner submits that the petitioner should have liberty to raise any objection against calculation chart if it is found that the calculation is incorrect. Considering the fact that the entire admitted dues has been paid to the petitioner against the General Provident Fund amount, this application stands disposed of with a liberty to the petitioner to approach District Provident Fund Officer, Nalanda, by raising specific grievances relating to the discrepancies, if any, in the calculation of General Provident Fund amount. If any, such claim is raised within two months from today, the District Provident Fund Officer, Nalanda, shall be obliged to look into it and pass appropriate order and communicate the same to the petitioner within a period of two months, thereafter.
