2. This application has been filed for quashing the order dated 10.03.2015 registered for the offence under Section 498A of the Indian Penal Code passed by SDJM, Darbhanga.
3. The petitioners are the mother-in-law and fatherin-law of the opposite party no. 02. Notice was issued to the opposite party no. 02 but she has chosen not to appear thereafter a report was called from the Senior Superintendent of Police, Darbhanga and a report has been received from which it appears that the O.P. No. 02 has left the family of the petitioners and she

The CR Case No.1152 of 2014 was filed on 18/7/2014 before the Court of learned C.J.M Darbhanga against the petitioners and 4 others for offence under Sections 307/498A/323/379/406 of the I.P.C and Section 3/4 of Dowry Prohibition Act by the complainant Supriya Kumari wife of one Suraj Kumar. In short, the allegations alleged against the petitioners and other accused persons are that the complainant was married with Suraj Kumar. After marriage, accused persons started torturing the complainant for demand of dowry. It has further been alleged that the mother-in-law of the complainant tried to kill her by giving poison. She also alleged that when she was in her sasural, her sister-in-law (Nanad) namely Chanda Devi and maternal father-in-law namely Anil Singh told her that her husband is going to join Government job and therefore she should ask her parents to give Rs. 5 lakhs to them and when the complainant refused to pay the same, her husband assaulted her and ousted her from his house and therefore, this case has been filed.

5. The allegations levelled against the petitioner are general and omnibus and it appears that the opposite party no. 02 has no interest in the matter as she has chosen not to appear and is leading a happy married life.
6. In these circumstances, no useful purpose will be served by keeping this case pending and continuance of the present prosecution will be an abuse of the process of the Court.
7. Accordingly, this application is allowed and the order dated 10.03.2015 registered for the offence under Section 498A of the Indian Penal Code passed by SDJM, Darbhanga is hereby quashed with regard to the petitioners only. (Sandeep Kumar, J) Vikas/- U
