The petitioner apprehends his arrest in connection with Shahpur P.S. Case No.441 of 2021 registered under Sections 30(a), 30(c), 34, 41 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from the sarki field which is open place.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Patna High Court CR. MISC. No.18493 of 2023(2) dt.19-05-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Excise Judge, Danapur in connection with Shahpur P.S. Case No.441 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
