JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. 1117 of 2010 in which cognizance has been taken for the offences punishable under Sections 420, 120B, 467, 468, 471, 323, 504 of the Indian Penal Code.
It appears from perusal of complaint petition that there was land dispute between the parties and allegedly, petitioners produced false document in a criminal case. The contention on behalf of the petitioners is that a title suit bearing Title Suit No. 183 of 2009 is pending between the parties and as a matter of fact, the complainant has brought this
Patna High Court Cr.Misc. No.7053 of 2015 (2) dt.23-02-2015 false case with an intent to put pressure upon the petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ashok Kumar II, Judicial Magistrate 1st Class, Uda-Kishunganj, Madhepura in Complaint Case No. 1117 of 2010 subject to condition as laid down under Section 438(2) of the Cr.P.C.
