The petitioner is seeking regular bail in Mahnar P.S. Case No. 64 of 2014 registered under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the mother-in-law and has been falsely implicated without there being any material against her. She is in custody since 09.11.2016 and the father-in-law has been granted regular bail by a co-ordinate bench of this Court in Cr. Misc. No. 23218/2017. The petitioner has no criminal antecedent and she is

Patna High Court Cr.Misc. No.25745 of 2017 (2) dt.13-06-2017 2/2 ready to cooperate in the trial. Learned counsel further submits that the husband has already surrendered and he is in custody. Learned A.P.P. opposed the prayer for bail.

Considering the facts and circumstances of the case as also the fact that a co-accused being the father-in-law has already been granted regular bail by a co-ordinate bench of this Court, let the petitioner, namely, Sumitra Devi be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Vaishali at Hajipur in Sessions Trial No. 322/2016 arising out of Mahnar P.S.
