The petitioner seeks bail in connection with Bhagwanpur (Belaon) P.S. Case no. 206 of 2017 registered under Sections 30(a), 37(a) (b) of Bihar Prohibition & Excise Act-2016. 18 lts. of country made liquor is said to have been recovered from the house of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The house from where the alleged liquor is said to have been recovered is inhabited by several other family members of the petitioner. Though, other two cases under

Patna High Court Cr.Misc. No.7082 of 2018(2) dt.12-02-2018 2/2 Excise Act has been lodged against the petitioner but he is on bail in the said cases. Petitioner has been languishing in custody since 20.12.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-cum-A.D.J. Kaimur at Bhabua in connection with Bhagwanpur (Belaon) P.S. Case no. 206 of 2017. (Prakash Chandra Jaiswal, J) rohit/- U T
