2. Considering the preliminary objection raised by the respondent Union of India with respect to availability of alternative remedy, learned Advocate for the petitioner after some argument seeks permission to withdraw the writ petition with a liberty to approach before the Armed Forces Tribunal,

3. In view thereof, the present writ petition stands dismissed with the liberty aforesaid.

4. It is needless to observe that in case the petitioner approaches before the Armed Forces Tribunal, the delay, if any, shall be considered in the light of Section 14 of the Limitation Act.
