Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Submission is that the petitioner is not named in the F.I.R. Petitioner was not put on T.I. parade nor any incriminating article was recovered from his possession. Name of the petitioner surfaced in the confessional statement of the co-accused before the police while in police custody. Petitioner is in custody since 13.08.2020.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.22546 of 2021(2) dt.03-09-2021 2/2 Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Adapur P.S. Case No. 30 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
