Petitioner apprehends his arrest in connection with Lakhisarai (Mahila) P. S. case no. 33/2013 registered under sections 498A, 406, 380 of the IPC and 3/ 4 of the D.P. Act. It appears that marriage of the petitioner was solemnized with the informant 20 years ago and after marriage she became mother of three children but subsequently, dispute cropped up between informant and the petitioner.
It further appears that learned Sessions Judge tried his best to patch up the dispute of the parties but could not succeed. Furthermore, order dated 14.8.2014 passed in ABP no. 87/2014, it would appear that the petitioner was ready to keep the informant but she took time on the pretext to go to her in-laws' house after month of Bhado.
Patna High Court Cr.Misc. No.8751 of 2015 (2) dt.04-03-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in Lakhisarai (Mahila) P. S. case no. 33/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
