15-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking Regular Bail in connection with Ghorasahan P.S. Case No. 116 of 2017 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the allegation is of seizure of approximately 9 litres of country made liquor from the motorcycle of this petitioner. Learned counsel further submits that petitioner has got clean antecedent, the seizure is not in accordance with Seciton 100 Cr.P.C. and the petitioner is in custody since 17.03.2017.
Patna High Court Cr.Misc. No.25986 of 2017 (2) dt.15-06-2017 Learned Additional Public Prosecutor opposes the prayer for bail of the petitioner.
Considering the nature of allegation, the clean antecedent of the petitioner and that he is in judicial custody for approximately three months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Dhaka, East Champaran, in connection with Ghorasahan P.S.
