The petitioner seeks regular bail in connection with Darauli P.S. Case No. 54 of 2017, registered for the offence punishable under Sections 272, 273, 308 and 34 of the Indian Penal Code and sections 30(a), 38(i) and 41(i) of Bihar Excise Act, 2016..

The allegation, according to the informant, is that on receiving secret information, a team was constituted for the purposes of apprehending the accused persons. It is further alleged that when the police party reached at the barrier of Pipa pool, the petitioner was apprehended by the police while he was crossing the border on cycle. On inspection of the two packets loaded on

Patna High Court Cr.Misc. No.29004 of 2017 (2) dt.01-07-2017 2/2 the cycle, 45 pieces of packets containing country made liquor were found.

It is the submission of the learned counsel for the petitioner that the petitioner has clean antecedent and he is in custody since 12.03.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III, Siwan in connection with Darauli P.S.
