The petitioner seeks bail in connection with Barh P.S. Case No. 588 of 2019, registered under Section 364(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R that on the basis of written report of informant Lalita Devi, Barh P.S. Case No. 588 of 2019, under Section 364(A) of the Indian Penal Code was instituted against unknown regarding kidnapping of her grandson. Further submission is that, in fact, there was money dispute in between informant and one Gautam Kumar due to that reason, Gautam Kumar, forcibly, kept the grandson of informant in his house. In course of investigation, the petitioner and others

Patna High Court CR. MISC. No.13857 of 2020(2) dt.03-03-2020 2/2 reached at the house of Gautam Kumar and took the grandson of the informant at Police Station, where petitioner and three others were apprehended. Further submission is that the statement of victim was recorded under Section 164 Cr.P.C. in which he has not made any complaint against the petitioner. The petitioner has no criminal antecedent and he is in custody since 02.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Barh, Patna in connection with Barh P.S. Case No. 588 of 2019.
