Petitioner, already in custody, seeks bail in connection with Bairgenia P.S. Case No.278 of 2016, registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is allegation against eight persons having assaulted the deceased with iron rod but only one injury was found on the head of the deceased and other to co-accused, similarly situated, namely, Shiv Shankar Mahto and Bhairo Lal Mahto @ Bhairav Lal Mahto were admitted to bail by order dated 20.06.2017 passed in Cr. Misc. No.20236 of 2017 and Cr. Misc. No.19686 of 2017 respectively.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.8670 of 2018(3) dt.14-03-2018 2/2 petitioner Dhani Lal Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Bairgenia P.S. Case No.278 of 2016.
