The petitioner seeks bail in Sakra P.S. Case No. 128 of 2017 registered under Section 392 of the Indian Penal Code. Four motorcycle borne criminals are said to have plundered the motorcycle of the informant.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. He was not put on T.I.P. No incriminating article has been recovered from his conscious physical possession. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring his confessional statement recorded before the police
Patna High Court Cr.Misc. No.8422 of 2018 (3) dt.16-03-2018 2/2 which has no evidentiary value in the eye of law. The petitioner has been languishing in custody since 07.07.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-VIII cum Additional Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S.
