The present case relates to appointment on the post of Constable against Advertisement No 01 of 2004 and 02 of 2004. Learned counsel for the State submits that the appointments have already been made, the persons have already joined and whatever vacancy is left over has already been consumed in the succeeding selection and so much so no longer any post is

Learned counsel for the petitioner submits that already one matter with respect to the aforesaid Advertisement No 01 of 2004 and 02 of 2004 is pending before the Hon'ble Apex Court. That matter relates to contempt proceeding, not against the substantive proceeding. This Court does not find any reason to keep the matter pending. This application is, accordingly, dismissed. If any final order is passed which is in favour of the petitioner, the case of the petitioner will also be governed by that order of the Hon'ble Apex Court.
