The petitioner seeks bail in connection with Muzaffarpur Town P.S. Case No. 694 of 2017 registered under Sections 272, 273 of the Indian Penal Code and under Sections 30(a)/38(1)/41(2)/47 of Bihar Prohibition and Excise Act. 166.740 of foreign liquor is said to have been recovered from Scorpio vehicle and the petitioner and one Anand Kumar were apprehended. The petitioner happens to be driver of the said vehicle while Anand Kumar divulged to the police that he had purchased the aforesaid liquor from Manish Sah. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.1572 of 2018 (2) dt.24-01-2018 that no incriminating article has been recovered from his conscious physical possession. As a matter of fact, one Anand Kumar, who happens to be commuter of the vehicle, had loaded the said liquor in his vehicle in the cartoon and the petitioner had no knowledge about keeping of alleged liquor in the said cartoon. Though, one another case under Excise Act has been lodged against the petitioner but he has been enlarged on bail in the said case. The petitioner has been languishing in custody since 25.09.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 694 of 2017.
