JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2017 This application is for grant of bail in connection with Surajgarha P.S. Case No. 75 of 2017 registered for the offence(s) under section(s) 376, 511, 342 of the Indian Penal Code and section 8 of the POCSO Act.

Allegation against the petitioner is of attempting to commit rape upon the daughter of the informant. Submission of the learned counsel for the petitioner is that they are neighbour and due to some dispute, the petitioner has falsely been implicated in this case. The petitioner is in custody for three months.

Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, at this stage I am not inclined to

Patna High Court Cr.Misc. No.30664 of 2017 (3) dt.19-07-2017 2/2 grant bail to the petitioner. However, he may renew his prayer for bail after framing of charge.

With the above observation, this application is dismissed.
