JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Nanpur P.S. Case No.221 of 2017 registered under Sections 406, 409 and 420 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the FIR has been instituted by the police after several years of superannuation of the petitioner alleging that part of the work of construction was not completed by the contractor causing loss to the tune of rupees 1,34,418/-. He submitted that in order to show his bona fide, the petitioner has already deposited rupees 1,58,271/- in BEP Civil Construction Capital Head A/C

Patna High Court Cr.Misc. No.1389 of 2018 (2) dt.19-01-2018 2/2 No.3718781152 on 07.11.201. He submitted that the petitioner is an old person having roots in the society and is not likely to abscond or tamper with the evidence.

Having regard to the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Nanpur P.S. Case No.221 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
