JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and section 7 of the E.C. Act.
On 19.1.2016 the business premises of the petitioner was inspected when 175 bags of wheat each containing 50 kilograms were seized which were suspected to be government supply.
It is submitted by the learned counsel for the petitioner that the petitioner is Proprietor of M/s Rishabh Galla Bhandar, a registered food grains dealer and income tax payee. The petitioner also pays sales tax and is a registered Value Added Tax payee. It is further submitted that only on suspicion the accusation has been
Patna High Court Cr.Misc. No.9368 of 2016 (2) dt.01-03-2016 2/2 levelled. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Vaishali at Hajipur in connection with Jandaha P.S. Case No.9 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
