The petitioner is apprehending his arrest in connection with Aurangabad Town P.S. Case No. 113 of 2017 registered for the offence under Section 420, 467, 468, 471/34 of the I.P.C.

As per written report, the allegation is that this petitioner and other co-accused named in the FIR committed fraud and brought into existence a registered sale deed in the name of one of the FIR co-accused Gopal Singh. The accused persons impersonating the informant got the sale deed executed by setting a different lady. The allegation of impersonation is omnibus. The informant has lodged the case against the full brother of her husband. There appears bona fide land dispute between the parties as a Title Suit no. 12 of 2010 filed by the mother-in-law of the

Patna High Court Cr.Misc. No.30846 of 2017 (2) dt.06-07-2017 informant against her husband and another Title Suit no. 41 of 2017 with respect to land in dispute are pending between the parties as asserted by the petitioner at paragraph 11 of the application. This petitioner allegedly witnessed the sale deed in question and no specific act of committing forgery has been alleged against him.

In the facts and circumstances of the case the prayer of bail application is allowed. The petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad Town P.S. Case No. 113 of 2017, subject to the condition as laid down under Section 438(2), the code of Criminal Procedure. (Sanjay Kumar, J) rohit/- U T
