JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Bind P.S. Case No. 07 of 2017 registered under Sections 459, 307, 326, 506 and 120B of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, Rakesh Kumar and his four friends entered into the house of the informant and opened fire on her in the night.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case. The petitioner is not named in the F.I.R. The informant has not named the petitioner in the occurrence rather the son of the petitioner Rakesh Kumar and his four friends. There is no eye witness of the

Patna High Court Cr.Misc. No.29505 of 2017 (2) dt.01-07-2017 2/2 occurrence. There is nothing on the record indicting the complicity of the petitioner in the offence. The petitioner has been languishing in custody since 03.04.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Nalanda at Biharsharif in connection with Bind P.S. Case No. 07 of 2017.
