Petitioners, already in custody, seek bail in Mahua P.S. Case No.104 of 1997 registered under Sections 366(a), 498A and 120(B) of the Indian Penal Code.

Allegation in brief is that during investigation, it transpired that these two petitioners played key role and enticed away the victim girl.

Submission is that the petitioners were not named in the F.I.R. However, during investigation, the name of these two petitioners came in her statement recorded under Section 164 of the Cr.P.C. These petitioners are ladies and now the accused persons from whose house the girl was recovered were acquitted after trial, in fact the

Patna High Court Cr.Misc. No.32987 of 2017 (2) dt.20-07-2017 2/2 victim was a married lady and was in love relationship with one Satendra Kumar and they voluntarily have eloped but due to other reason, these petitioners were named by her.

Having considered the said facts and circumstances, the petitioners, namely, Nilu Devi and Soni Devi are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No.104 of 1997 with a condition that he shall remain physically present during the course of trial on each and every date. On failure to appear on two consecutive dates without any reasonable cause, his bail bonds shall be cancelled. (Arun Kumar, J) N.H./- U T
