====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-05-2022 Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Sections 302, 201/34 and 379 of the Indian Penal Code.

As per the F.I.R., on 19.07.2021 at about 6:00 PM, father of the informant went to village Maheshwari, but did not return and on the next day, at about 6:30 PM, the informant came to know that all the F.I.R. named accused persons including this petitioner committed the murder of his father and threw the dead-body near Ram-paharijor and also looted away cash of Rs. 39,000/- from him (father of informant). It is submitted on behalf of petitioner that only suspicion has been raised against this petitioner and during course of investigation, no substantive material has been collected against this petitioner to show his involvement in the

Patna High Court CR. MISC. No.12919 of 2022(2) dt.10-05-2022 2/2 aforesaid occurrence. It is further submitted that though, date of occurrence is 19.07.2021, but F.I.R. has been lodged on 23.07.2021 without any plausible explanation of delay and petitioner is in custody since 06.01.2022, having no criminal antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui in connection with G.R. No. 2104 of 2021, arising out of Sono (Charpathar) P.S. Case No. 197 of 2021. (Prabhat Kumar Singh, J) anay/- U T
