Petitioner seeks regular bail in connection with Maner P.S. Case No.225 of 2017 registered for the alleged offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 152 liters of foreign liquor is said to have been recovered from the field of one Sudama Kunwar and petitioner along with two other persons were apprehended while two others managed to escape. It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. He has been falsely implicated in this case. There is no recovery from the conscious physical possession of the petitioner. There is no specific allegation against the petitioner but the allegations are general and omnibus in nature. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Maner P.S. Case No.225 of 2017.
