JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioners and the State. The petitioners being Panchayat Rojgar Sewak and Programme officer are apprehending arrest in a case registered for the offences punishable under Sections 420,409,467,468,471 and

Patna High Court Cr.Misc. No.17417 of 2015 (2) dt.14-05-2015 2/3 120B of the Indian Penal Code.

Initially the complaint was filed but subsequently after being transferred under section 156(3) Cr.P.C. Sikandra P.S. Case No. 131 of 2014 was registered. It is alleged by the informant that forged job card was prepared in the name of the informant's wife Sushila Devi, forged accounts were opened in the post office on the basis of fraudulent entry in the muster roll, consequently the attendance of the wife of the informant was marked from 30.8.2010 to 18.2.2014 and thereby Rs.37,404/- was fraudulently withdrawn. Similar fraudulent withdrawal was made with regard to 174 days wages in the name of informant. It is also alleged that Rs.12,765/- was withdrawn as wages for the period 2.10.2010 to 22.1.2014 with regard to the daughter in law of the informant namely Baby Devi and son Barun Thakur. The whole exercise was done by the middle man Raj Kumar Singh. On protest being made the informant was abused.

It is submitted by the learned counsel for the petitioner Rajeev Kumar Anand that he was transferred to Sikandara Block on 7.8.2013 when the account was opened in 2010 when petitioner Binod Kumar was posted as Programme Officer from 26.3.2013 to 4.3.2014 and other similarly situated co accused have been granted bail vide Cr. Misc. nos. 3439,3553,4357 and 8920 of 2015.

No.17417 of 2015 (2) dt.14-05-2015 3/3 Considering the delayed lodging of the case and similarly situated accused being granted bail, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jamui in connection with Sikandara P.S. Case No. 131 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
