JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-03-2016 Heard learned counsels for the petitioner and the State. The petitioner being the married sister of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after about three years of the marriage for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the informant received information about the occurrence on 10.12.2013 and he went to in-laws house of his daughter to meet her on 15.12.2013 when the victim died on 26.12.2013. The complaint petition was prepared on 02.01.2014 which was signed

Patna High Court Cr.Misc. No.10810 of 2016 (2) dt.15-03-2016 2/2 by the lawyer on 03.01.2014 which was actually filed on 21.02.2014 which came to be registered as a police case on 06.03.2014. There is no specific accusation against the petitioner as petitioner used to reside at different place. The thrust of accusation is against the husband of the victim who has been granted bail.

Considering the delayed lodging of the case and thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Barh in connection with Barh P.S. Case No. 68 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
