Petitioner seeks regular bail in a case registered for the offence punishable under Section 498A/34 of the Indian Penal Code and u/s 3⁄4 of Dowry Prohibition Act. As per the prosecution case, this petitioner along with other accused persons tortured the informant for dowry. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that earlier also the informant has filed Danapur PS case No. 408/2016 against this petitioner and others
Patna High Court CR. MISC. No.13244 of 2022(2) dt.10-05-2022 2/2 in which petitioner has already been granted anticipatory bail by this court (Annexure-2). Petitioner is in custody since 18.01.2022 and investigation in this case is complete. Learned counsel appearing for the State and the informant vehemently opposed the prayer for bail and submitted that petitioner is habitual offender. Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Kako PS case No. 177/2021.
