JUSTICE ARUN KUMAR ORAL ORDER 12-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.10.2017, seeks bail in Habibpur PS Case No. 36 of 2016 registered under Sections 302, 34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that some unknown miscreants killed the informant's younger brother by fire arms. Learned Counsel for the petitioner submits that the FIR is against unknown and the police on suspicion apprehended one Md. Imran, who confessed about his involvement in the occurrence along with this petitioner and others, however Md. Imran has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 5953 of 2018 and he too has criminal antecedent like the petitioner. Having considered the aforesaid facts and circumstances, on the ground of parity as Md. Imran has been granted bail, so the petitioner, namely, Md. Samir @ Samir @ Lalu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XII, Bhagalpur in connection with Habibpur PS Case No. 36 of 2016.
