The petitioner apprehends his arrest in connection with Kumarkhand P.S. Case No. 60 of 2020 registered under Sections 420 and 409/34 of the Indian Penal Code. Learned counsels appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is the former Mukhiya of the Gram Panchayat. The total amount under the Sat Nishchay Gali-Nali Scheme allotted was Rs. 1,21,00,065/- which was deposited to the account of the petitioner. Further he submits that petitioner has already transferred Rs. 97,34,200/- to the account of ward members by
Patna High Court CR. MISC. No.23895 of 2021(7) dt.11-04-2022 2/2 means of cheque and RTGS and the said amount has been utilized by the ward members. He also submits that on urgency, by the verbal order of the District Magistrate, petitioner has also expanded Rs. 11,40,170/-.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Madhepura in connection with Kumarkhand P.S. Case No. 60 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
