JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323 and 324 of the Indian Penal Code.

The prosecution case is that on protest being made for peeping while ladies of the informant's side was taking bath, the accused persons assaulted the informant and his family members. It is submitted by learned counsel for the petitioner that for the petty dispute, there was a free fight between the parties when none received any injuries from informant's side, statement to that effect has been made in para 10 of the petition which reads as follows:- "That it shall further be relevant to state that there is nor injury report, rather no body sustained injury in this case."

Case No. 240 of 2013 against the informant's side at earlier point of time. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Banka in connection with Katoria (Suiya) P.S. Case No. 241 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
