Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 06 of 2017, registered for the offences punishable under Sections 414, 399, 402 of the Indian Penal Code and 25(1-b)a, 26 & 35 of Arms Act. It appears that the arrested co-accused persons namely Sonu Kumar and Suraj Kumar disclosed the name of the petitioner. Some arms and ammunitions were recovered from the

Patna High Court CR. MISC. No.23216 of 2021(3) dt.25-02-2022 2/2 possession of arrested accused persons.

Learned counsel for the petitioner has submitted that except the confessional statement of co-accused there is nothing against the petitioner in entire case diary. No incriminating article was recovered from his possession. His criminal antecedent and case diary was called for, which shows he has no criminal antecedent at all.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IIIrd, Hajipur in connection with Bhagwanpur P.S. Case No. 06 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
