Petitioner, already in custody, seeks bail in connection with Mirganj P.S. Case No.275 of 2017, registered under Sections 365 and 363/34 of the Indian Penal Code. Allegation in brief is that 7-8 unknown persons kidnapped the grandson of the informant along with one Chhotan Dubey.

Learned counsel for the petitioner submits that two boys were not recovered from possession of the petitioner, except confessional statement of the petitioner that he had brought those two boys to know whether they had any knowledge about the whereabout of his stolen motorcycle, there is no other material and the petitioner has no criminal

Having considered the aforesaid facts and circumstances, petitioner Kapildeo Prasad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XVI, Gopalganj in connection with Mirganj P.S. Case No.275 of 2017.
