The petitioner seeks regular bail in connection with Dalsingsarai PS case no. 276 of 2018 registered for the offence punishable under Section 394 of Indian Penal Code. The allegation is regarding unknown accused persons having committed loot in the house of the informant on the pistol point.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, inasmuch as neither he is named in the FIR nor any recovery has been made from the petitioner nor any T.I. parade has been held so as to connect the petitioner with the alleged crime. It is further submitted that the petitioner is an accused in

Patna High Court CR. MISC. No.12513 of 2019(2) dt.28-02-2019 2/2 one other case but he is on bail in the said case. The petitioner is said to be languishing in custody since 08.10.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Dalsingsarai, Samastipur in connection with Dalsingsarai PS case no. 276 of 2018.
