====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-03-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act.
3. As per the prosecution case, on secret information that some miscreants have assembled to commit crime, raid was conducted and three co-accused persons were apprehended on the spot with arms who disclosed the name of this petitioner.
4. It is submitted that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has been made accused only on the basis of confessional statement of co-accused persons. Petitioner claims

5. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Madhubani in connection with Kaluahi P. S. Case No. 143 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
