Petitioner apprehends his arrest in connection with Excise Case No. 160 of 2010 registered under Section 47 of the Excise Act.

Learned counsel for the petitioner submits that petitioner has been implicated in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from an open field. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed

Patna High Court Cr.Misc. No.27923 of 2017 (3) dt.18-07-2017 2/2 to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII, Gaya in connection with Excise Case No. 160 of 2010 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
