JUSTICE ARUN KUMAR ORAL ORDER 28-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rajeev Nagar PS Case No. 240 of 2017 registered under Section 380 of the IPC. The FIR is against unknown and the petitioner is made accused on the basis of confessional statement; one sari and a stone were recovered from his tempo alleged to be stolen articles. Learned Counsel for the petitioner submits that the so called sari and stone were not put on TIP, he was apprehended after a week of the alleged occurrence merely on the basis of confessional statement, however he has no criminal antecedent and is in custody since 16.9.2017.
Having considered the said facts and circumstances, the petitioner, namely, Golu Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IIIrd, Patna in connection with Rajeev Nagar PS Case No. 240 of 2017.
