====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 20-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Danapur P.S. Case No.566 of 2015 registered under Sections 25(1-b)A and 26 of the Arms Act.

The accusation is that in course of raid, the police recovered one country made pistol and two live cartridges from beneath the pillow of the bed of the co-accused Satyendra Rai alias Nunu Rai whereas one country made pistol alongwith five live cartridges, kept in the Jar, are said to be recovered from behind the house of the petitioner.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.9852 of 2016 (2) dt.20-04-2016 2/2 submits that it would appear from the F.I.R. that the petitioner was not caught on the spot and the alleged recovery of one country made pistol and five live cartridges were made from behind the house of the petitioner and not from the house of the petitioner. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Danapur P.S. Case No.566 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
